Terms of Service

1. Acceptance of Terms
By accessing and using Workstamp services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.
2. Service Description
Workstamp provides a software-as-a-service (SaaS) platform for employee time tracking, designed to comply with Spanish Royal Decree-Law 8/2019.
The service includes:
- Clock-in and clock-out system
- Immutable working time records
- Compliance report generation
- Administration panel for businesses
- Data export for audits
3. Registration and User Account
3.1 Registration requirements
To use Workstamp you must:
- Be at least 18 years old
- Provide truthful and complete information
- Keep your account information up to date
- Be responsible for the confidentiality of your credentials
3.2 Account responsibility
You are responsible for all activities carried out under your account. You must notify us immediately of any unauthorized use.
4. Plans and Pricing
4.1 Available plans
- Starter: €10/month - Up to 10 users
- Professional: €25/month - Up to 50 users
- Enterprise: Custom pricing - Unlimited users
4.2 Billing
Billing is done monthly in advance. Prices do not include VAT, which will be added according to applicable legislation.
4.3 Price changes
We reserve the right to modify prices with 30 days notice. Changes will not affect the already billed period.
5. Acceptable Use
When using Workstamp, you agree to:
- Use the service only for legitimate time tracking purposes
- Not attempt to access systems or data without authorization
- Not interfere with the operation of the service
- Not use the service for illegal activities
- Comply with labor and data protection regulations
6. Client Obligations (Businesses)
As a business client, you agree to:
- Inform your employees about the use of the time tracking system
- Comply with data protection regulations (GDPR)
- Use time tracking data in accordance with the law
- Designate an administrator responsible for the account
- Properly manage access permissions for your employees
7. Intellectual Property
Workstamp and all its components (software, design, logos, documentation) are owned by the Company and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the service according to these terms.
8. Data Protection
Personal data processing is governed by our Privacy Policy.
Workstamp acts as:
- Data controller: For business account data
- Data processor: For employee data of client businesses
9. Service Availability
We strive to maintain 99.9% availability. However, we do not guarantee that the service will be available uninterrupted.
We may perform scheduled maintenance, which will be notified in advance when possible.
10. Backups and Data Retention
We perform daily backups of all data. Time tracking records are retained for the legally required period (minimum 4 years).
Data is stored using SHA-256 hash chains to ensure integrity and immutability.
11. Limitation of Liability
To the maximum extent permitted by law:
- Workstamp shall not be liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the service in the last 12 months
- We do not guarantee that the service will meet specific requirements beyond general regulatory compliance
12. Warranties
We warrant that:
- The service is designed to comply with Spanish RD 8/2019
- Time tracking records are immutable and auditable
- We implement appropriate security measures
Except as expressly stated, the service is provided "as is" without additional warranties.
13. Cancellation and Termination
13.1 By the client
You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period.
13.2 By Workstamp
We may suspend or terminate your access if:
- You breach these terms
- You fail to make corresponding payments
- You use the service fraudulently
13.3 Effects of termination
After termination, you will be able to export your data for 30 days. Data will be retained according to legal requirements.
14. Modifications to Terms
We may modify these terms at any time. Substantial changes will be notified at least 30 days in advance.
Continued use of the service after modification implies acceptance of the new terms.
15. Governing Law and Jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Pontevedra, Spain, waiving any other jurisdiction.
16. General Provisions
- If any provision is found invalid, the others shall remain in force
- Failure to exercise a right does not imply waiver
- These terms constitute the entire agreement between the parties
